I'm going to go ahead and entertain the idea that hackers did breach Clinton's email, that still doesn't make what she did any different from what politicians before her have done. What precedent are you trying to set here? That politicians can use non-government emails but if they get hacked (which isn't in their control obviously) they go to prison? This would be like if drunk driving was only illegal if you hit someone. Even that comparison isn't spot on though.
